The first witness called on Day Two of the inquest was Steven Novotny1, owner of the large chocolate Labrador dog that had bitten Erik in March 2010. Novotny said he’d been home alone—contrary to what his wife later claimed—when he noticed his condo’s front door was open and their dog missing. He went outside and found a redheaded guy had

“pinned” the dog to the ground, and had his foot on the poor critter’s neck.

Novotny also claimed the guy was “wearing sweats and a beanie.”

Erik allegedly pointed a gun at Novotny and yelled something about “killing your f**** dog!” The witness claimed he apologized, while struggling to get a collar and leash on the dog, and Erik departed. For reasons he didn’t explain, Novotny said he went back into the condo, grabbed his own gun and “went looking for the guy.”

As the prosecutor frantically tried to get his witness to shut up, the courtroom burst out laughing. The sole purpose of putting Novotny on the stand was to underpin the falsehood that Erik was a whacked out gun nut prone to violence, but the witness had just assumed that mantle for himself!

Had Ross Goodman been able to cross-examine the dog owner, he would have made these points: That powerful 75-pound dog had just attacked and bitten Erik, lacerating the back of his right leg and leaving large bruises. How, then, could Erik have possibly caught and subdued the animal—which had no collar—singlehandedly and held it to the ground with a foot on the canine’s neck?

And Erik was not wearing sweats and a beanie. He was dressed as a professional in expensive slacks and a long-sleeved shirt. He’d been loading $30,000 worth of pacemaker equipment into his car before going to work, when the dog assaulted him. Beanie caps weren’t part of his day-to-day professional wardrobe, either.

The next series of witnesses detailed the incredibly inept handling of Costco’s security system surveillance video. Shai Lierley2 described the system’s configuration and contended that a critical video recorder had started “locking up” on Wednesday, July 7th, three days before Erik was shot to death.

He’d purportedly called Costco’s video contractor, Vegas Valley Locking Systems, to report the problem, but elected to wait until the following Monday to have the balky digital video recorder or DVR

serviced. Under oath, Lierley claimed he merely preferred to wait until technician Jonny Harms was available. Besides, he said, “we don’t consider video a huge priority.” He also wasn’t required to notify Costco’s corporate headquarters that the Summerlin store’s surveillance system was inoperative.

Not so, according to Dr. Gary Presswood, the security system expert, who had disputed Lierley’s testimony. Costco would never tolerate leaving a video surveillance system out of commission for days. Lierley had committed unabashed perjury—but would never be challenged during the one-sided inquest.
